We are not a law firm and we do not give legal advice. When our customers need a solicitor, we would rather refer them to one than pretend otherwise.
Our position, stated plainly:
Silent Erase is a privacy protection service, ICO registered (C1971457). We generate and send GDPR requests as agent for our customers, on their instruction. We are not authorised to conduct litigation, we do not have rights of audience, and we do not provide legal advice.
That means there is a clear point where our service ends and a solicitor's begins. Rather than blur that line, we would like to know who to send people to.
Where our customers need you
Compensation claims under Article 82
Where a data breach or unlawful processing has caused financial loss or genuine distress. We can evidence the breach; we cannot advise on or pursue a claim.
Persistent non-compliance
Organisations that ignore erasure requests and ICO involvement. Sometimes a letter on headed paper achieves what ours does not.
Defamatory or seriously harmful content
Where removal is not just a data protection matter. Outside our scope entirely.
Harassment and stalking
Where someone is using publicly available data to locate or harass. Often needs injunctive relief, not an erasure request.
Family and separation matters
Address and data separation after relationship breakdown, particularly where safety is a concern.
Deceased estates
Where authority to act for a deceased person's data is contested or unclear.
What we would offer you
Qualified referrals
People who have already identified a problem, gathered evidence and exhausted the non-legal route. They arrive informed rather than at the "what are my rights" stage.
An evidence pack
Where the client has used our service, we can provide a documented trail — requests sent, dates, responses, non-responses. Useful groundwork.
Reciprocal referral
Your clients frequently need data removal that is beneath the cost of your time. We handle it and refer back.
Discounted service for your clients
Where it helps their matter, we can offer preferential rates to clients you refer.
On referral fees — your call, not ours.
We are aware that referral arrangements involving solicitors carry regulatory considerations, and that the position differs depending on the type of work. We are entirely comfortable with a reciprocal referral arrangement with no fees in either direction if that is cleaner for you.
We would rather have a compliant relationship with a firm we trust than a fee that creates a problem for either of us. Tell us what works within your obligations and we will follow it.
